
Narrowing the Gap
Recently, I decided that it was time to narrow the gap between our criminal
laws and the Mexican legal system, at least with respect to the fugitives who
think that they are eluding justice by escaping into Mexico. This prevalent
problem had to be attacked in one of two ways: seek the extradition of the
fugitive from Mexico through diplomatic channels, or ask that the Mexican
Government arrest and prosecute the fugitive in the Mexican courts pursuant
to Article 4 of the Mexican Federal Penal Code. Either way, my objective was
to make those criminals accountable for their crimes. Consequently, I created
a Foreign Prosecution Unit in my office, and I am proud to report that we are
busy doing both, extraditing fugitives and getting them prosecuted in Mexico.
This website is a part of our efforts and it is intended to serve multiple
purposes. One, it is my hope that it will assist prosecutors and law
enforcement throughout the state and country to become more acquainted
with extraditions from Mexico and foreign prosecution laws. Two, this page
will be updated frequently with news, events, proposed legislation, and
important court decisions. In short, we hope to provide a wealth of
information and guidance in these areas of the law.
Also, we will monitor extradition requests and cases that have been filed in
Mexico for prosecution and publish their progress here.
I would encourage prosecutors and law enforcement officers to contact
members of my Foreign Prosecution Unit with questions either through e-mail
or by telephone—we are prepared to help.
Finally, in conjunction with the Procuraderia General de la Republica de
Mexico (PGR), my office has published a Foreign Prosecution Book that sets
out step by step how to prepare either an International Extradition or Article 4
